Land Use Planning Around Military Installations
Missouri Revised Statutes §41.665 (H.B. 348 of 2005) requires the governing body or the county planning commission of Johnson County to provide for the planning and zoning within the unincorporated area that extends 3,000 feet outward from the boundaries of Whiteman Air Force Base and the area within the perimeter of accident potential zones one and two, as identified in the April 1976 Air Installation Compatible Use Zone Report.

Missouri Military Preparedness and Enhancement Commission
Missouri Revised Statutes §41.1010 (H.B. 348 of 2005) established the Missouri Military Preparedness and Enhancement Commission to “design and implement measures intended to protect, retain, and enhance the present and future mission capabilities of military posts and bases around the state.”  The Commission is required to prepare and present an annual report to the Governor and the General Assembly.  The nine-member Commission will meet at least quarterly or more as deemed necessary by the chair.

Legislation enacted in 2006 (H.B. 1944) prohibits the acquisition of private property solely for economic development purposes.

Open Space/Conservation

Design for Conservation Constitutional Amendment
Missouri voters approved a constitutional amendment in 1976 (Article IV, Section 43(b) of the Missouri Constitution) that permanently provides 1/8 of one-percent of the sales tax to the Missouri Department of Conservation for conservation activities.  The additional funds are to be used for the control, management, restoration, conservation and regulation of the bird, fish, game, forestry and wildlife resources of the state, including the purchase or other acquisition of property for said purposes.

Conservation Easement Statutes
Missouri Revised Statutes §67.870 et seq. authorize the Missouri State Park Board and specified cities and counties to acquire lands “necessary or appropriate to maintain, improve, protect, limit the future use of, or otherwise conserve and properly utilize open spaces and areas within such counties or cities.”

Missouri Military Preparedness and Enhancement Commission
The Missouri Military Preparedness and Enhancement Commission, located within the Department of Economic Development for administrative purposes, is tasked with making recommendations to the Governor and the General Assembly regarding community relations and interstate cooperation on military issues. The Commission also serves as a clearinghouse for information regarding federal actions affecting military installations and their potential impact on the state and local communities.

Legislative Process Regarding Military POCs
The Missouri Military Preparedness and Enhancement Commission, created in 2005, serves in an advisory role to the Governor and the General Assembly.  The Commission is within the Department of Economic Development and meets quarterly.  The House Veterans Committee has jurisdiction over legislation addressing the promotion and strengthening of states rights and military and naval affairs of the state.  The Senate Veterans' Affairs, Emerging Issues, Pensions and Urban Affairs has jurisdiction over legislation relating to veterans’ and military affairs.
